But "Dan Rather Reports" found evidence that the church has done just the opposite: Wealthy U.S. Dioceses from California to Delaware have claimed to be broke and have filed for bankruptcy to avoid paying damages; Bishops have exploited arcane corporate laws to shield church assets from liability; and, in San Diego, parish priests have been caught literally hiding money in safes, according to court records.

"If you or I did what the Diocese of San Diego did in that bankruptcy, we'd be charged with bankruptcy fraud, and we'd probably be in prison," said attorney John Manly, who has represented dozens of priest abuse victims in lawsuits across the country.

"Dan Rather Reports" found evidence that some high in the church hierarchy have provided guidance.

"One of the comments that came from one of the bankruptcy attorneys is that, 'These guys make Enron look like altar boys.' Pardon the pun," said Don McLean, who was abused as a 10-year-old altar boy, and sought damages from the San Diego diocese.

This is the most telling and depressing indication of Pope Benedict’s true priorities.

It took years before he even acknowledged clergy sex crimes and cover ups, much less begin to express solidarity with victims. But just days after a handful of his colleagues in Belgium were inconvenienced for a few hours, the Pope vehemently rallies to their defense. Because they share his occupation, nine potential wrong-doers merit more prompt and vigorous support from the Pope than hundreds of thousands of deeply wounded child sex abuse victims and still-vulnerable children across the globe.

According to the Associated Press, Benedict “also repeated that such crimes are handled by both civil and canon law ‘respecting their reciprocal specificity and autonomy.’” It is reckless and arrogant to equate civil and canon ‘law.’ In most nations, civil law is drawn up by a wide range of individuals and interests in open discussion, not strictly by a small, narrow, homogeneous handful of church men behind closed doors. In most nations, civil law is enforced by independent institutions and processes, not by a distant monarch.

One key reason why priests are still raping kids and bishops are still concealing these crimes is because the Pope and most of the Catholic hierarchy still refuse to accept that investigating child sex crimes and cover ups is the role of law enforcement.

Pope: Belgian sex abuse raids deplorable

VATICAN CITY – The pope has called the raids carried out by Belgian police investigating priestly sex abuse "deplorable" and asserted the autonomy of the Catholic Church to investigate abuse alongside civil law enforcement authorities.

Pope Benedict XVI issued a message Sunday to the head of the Belgian bishops' conference, Monsignor Andre-Joseph Leonard. In it, he expressed solidarity with all Belgian bishops for the "surprising and deplorable way" in which Thursday's raids were carried out.

Benedict said justice must take its course. But he also repeated that such crimes are handled by both civil and canon law "respecting their reciprocal specificity and autonomy."

The raids targeted a retired archbishop and the graves of two prelates.

Abuse victims can sue Vatican, court rules

This is good news. The Vatican and the Popes must not be "above the law" especially secular law. Justice must be brought upon them and jail them when they are found guilty. And they are all guilty of the cover-up of the John Paul II Pedophile Priests Army.

The U.S. Supreme Court cleared the way for sex-abuse victims to sue Pope Benedict when it refused Monday to hear the Vatican's appeal of an Oregon lawsuit.

St. Paul lawyer Jeff Anderson, who specializes in filing abuse suits against the Roman Catholic Church, called the decision "the biggest breakthrough in the movement's history."

"This is huge. Really, really huge," he said. "We've kicked down the iron gates that they've been hiding behind for all these years."

In declining to hear the case, the court upheld an appeals court ruling that the Vatican can be sued for sexual abuse if church officials knowingly reassign priests who have been accused of such acts in their previous parishes. The Vatican appeal had argued that the U.S. courts lacked jurisdiction over the Rome-based church.

Anderson predicted that now he can eventually depose Pope Benedict.

"I won't start with him; I'm going to work my way up," he said. "But this ruling gives me the ability to depose anybody within the organization who has knowledge about the events."

Before becoming pope, Cardinal Joseph Ratzinger oversaw the Congregation for the Doctrine of the Faith, the office that disciplines priests for abusive acts.

SNAP (Survivors Network of the Those Abused by Priests) issued a statement saying that the Supreme Court's decision "gives hope to hundreds of thousands of clergy sex abuse victims across the globe who know lies remain under wraps at the Vatican and will only be unearthed through persistent action by secular justice officials and systems."

The suit that led to the appeal was filed in 2002 by Anderson in Oregon for an unnamed 49-year-old man who alleges he was sexually abused as a teenager by a priest who had been reassigned after being accused of similar abuses in parishes in Chicago and Ireland.

Analysis of Benedict XVI’s homily in Year for Priests




Benedict XVI said at the first two paragraphs of his homily (our comments are in parenthesis)

…the Year for Priests which we have celebrated on the one hundred and fiftieth anniversary of the death of the holy Curè of Ars, the model of priestly ministry in our world, is now coming to an end. We have let the Curé of Ars guide us to a renewed appreciation of the grandeur and beauty of the priestly ministry.


(Comment: Benedict uses an old 150 year old model, the Curé of Ars, who was known for his bitter temper and who yelled and sent parishioners away feeling depressed, dejected and disconsolate because in the Confessional, he threatened them all with the fires of Hell for their sins, even their venial sins. The Curé of Ars is the antithesis of the healthy psychology we have today. About “the grandeur and beauty of the priestly ministry” that is deceptive advertising because priests today are ALL potential pedophiles who live in their own unrealistic and in-human spiritual bubble just like Fr. The priest is not a mere office-holder, like those which every society needs in order to carry out certain functions.


(Comment: This papal statement is an affront and blatant insult to all doctors (especially Doctors without Borders), engineers, nurses, office workers, computer analysts, firefighters, policemen, ordinary mothers and fathers who work to raise and feed their children, all who work certain functions to make the world running to serve 6 billion people. This theocratic position of Benedict XVI must end once and for all -- so we never have to hear this kind of insult again where Benedict XVI puts priest “above” secular society and above everyone else, especially “above” the law. This is the crux of the “reverence for priests” because the priest is the representative of God and the face of God as we will see in his lengthy speech which we will not go into because we can write a book about it. This “priest is not a mere office-holder” is an appalling insult to all people on earth because all people “carry out functions which every society needs”—but he insinuates that the priest is “above all people”. This “not a mere office-holder “is also the reason why John Paul II refused or made it almost impossible for priests to leave the priesthood and get laicized because priests are supposed to be “above the laity” and they are to be wizards of God’s flesh for life.)

Instead, he does something which no human being can do of his own power: in Christ’s name he speaks the words which absolve us of our sins and in this way he changes, starting with God, our entire life.

Over the offerings of bread and wine he speaks Christ’s words of thanksgiving, which are words of transubstantiation – words which make Christ himself present, the Risen One, his Body and Blood

The priesthood, then, is not simply “office” but sacrament:


(Comment: Benedict XVI puts down the ordinary work of laity as “office” and puts priesthood as “sacrament” above the “simply” office work of the laity. He preaches to the world that the priests are not common men but sacrament men. This special status of “not simply ‘office” harbours priests to commit grave sins and puts them “above the law” where they are feared for their exclusive powers in the “’sacraments”.)

God makes use of us poor men in order to be, through us, present to all men and women, and to act on their behalf.

(Comment: Benedict speaks with false humility when he says “us poor men” when he is sitting in the trillion dollars Chair of St. Peter and the Vatican Bank holds the billions of dollars of collections from the 1.1 billion Catholics and investors. There is nothing “poor” about priests, materially, psychologically, physically, sexually and spiritually. They have financial security which ordinary lay people do not have. They claim unparallel powers over mankind in that they alone have the exclusive power to forgive sins and reincarnate God’s flesh in 9-seconds. They can sodomize altar boys in the secrecy of the universal Catholic Church sacristies and rectories worldwide.)


This audacity of God who entrusts himself to human beings – who, conscious of our weaknesses, nonetheless considers men capable of acting and being present in his stead – this audacity of God is the true grandeur concealed in the word “priesthood”. That God thinks that we are capable of this; that in this way he calls men to his service and thus from within binds himself to them:

"For God knows that in the day you eat from it your eyes will be opened, and you will be like God, knowing good and evil." (Genesis 2:4-5) Benedict XVI spoke for God: “This audacity of God who entrusts himself to human beings… considers men capable of acting and being present in his stead - this audacity of God… [who] thinks that we are capable of this…” How dare Benedict preach that God would entrust himself only to priests but not to children and women and ordinary men???)

Benedict XVI manipulates the Devil as scapegoat for priests’ sins


1) Benedict XVI blames the Devil, just like Eve did, for his crimes and the ‘Priestly Sodomy of Biblical Proportions’ committed by the JPIIPPA John Paul II Pedophile Priests Army. In his homily, he never accepted responsibility for any of these crimes when in fact he is the most responsible leader who concocted with the Opus Dei the cover-up of JPIIPPA so that John Paul II can leave a legacy as “John Paul II the Great”. 2) Benedict XVI uses the Devil and Devil’s warfare with God as his main strategy. The priests are therefore the puppets of the Devil in his continuing battle with God.


Benedict said: “It was to be expected that this new radiance of the priesthood would not be pleasing to the 'enemy, he would have rather preferred to see it disappear, so that God would ultimately be driven out of the world.”


“So that God would ultimately be driven out of the world”? This is complete bullshit theology – Benedict gives so much power to the Devil over God who created this world! And he attributes powers of Satan to control priests to sin. Double Devil powers! Benedict XVI needs a lobotomy. Benedict speaks about "the audacity of God" in trusting men to be priests but at the same time he preaches of the power of ‘the enemy’ Satan.

Is this why these above-ordinary priests must keep on re-incarnating and reproducing Christ’s flesh and blood so that God will stay in this world and not be driven away by Satan? (Bullshit)

First, we must refuse to believe and refuse to obey Benedict and priests’ claims of priestly powers of transubstantiation in the Eucharist. (It is God who creates and commands man, not vice versa. Priests have no power to say, Let there be rain, and it rained; they cannot say, Let there be light, and there was light. Priests have no power to say, Let there be Christ’s flesh, and Christ obeyed. God is not a stupid God who obeys sinful men, or he is not God at all.)


Second, we must refuse to see “priests not simply ‘office’ but sacrament”. Priests are ordinary mortals who simply studied a bunch of theology books that are totally heartless like John Paul II and they harbour and commit the very sins they claim to forgive. Third, the Vatican must be removed of its status as a state with the Pope as its political Head of State, so that he will no longer have any diplomatic immunity. But of course, the trillion dollars Vatican Bank and the investments of all corrupt political Heads of states are at stake here, so the corrupt politicians will want to keep Benedict as a Head of state in order to maintain their blood money in the Vatican Bank, like they do in the Swiss Bank. So the wheel of corruption goes on like Benedict‘s upcoming trip to England, diplomatic immunity, diplomatic transfer of corrupt money like Cardinal Mahony’s annual 1 billion deposit to the Vatican Bank, tax-free, corrupt leaders visiting the Vatican Palace for a photo-op with Benedict while carrying caseloads of money in their diplomatic immunity airplanes to give to the Pope and the Vatican Bank. The Vatican Bank, now controlled by the Opus Dei, is the wealthiest single institution on the planet, more wealthy than Bill Gates and all billionaires combined.

Fourth, Cardinals and bishops, priests must be viewed as any regular workers on this earth, subject to secular laws and to secular justice, so that they will also stand trial and be jailed for their crimes, such as the pedophile crimes. Cardinal Mahony should resign in disgrace like Cardinal Bernard Law did here in Boston. (But with his billions of dollars, he has already bought all Los Angeles priests’ souls. It’s incredible that not one LA priest ask him to resign, so different from the collective priests here in Boston who demanded Cardinal Bernard Law to resign and they succeeded)



Fifth, Cardinal Bernard Law must step down as Archpriest of St. Mary Major in Rome and retire and die in disgrace as he deserves for his condone and cover-up of more than 100 pedophile priests in our city of Boston.

Since the Catholic sexual abuse crisis erupted a decade ago, there have been numerous attempts to explain its causes, from a lack of fidelity to an over-emphasis on celibacy and clerical privilege. This morning in Rome, Pope Benedict XVI pointed to a deeper unseen force lurking behind the crisis, especially its timing: the Devil.
It’s no accident, the pope implied, that precisely as the Catholic church was celebrating a “Year for Priests” in 2009-2010, the sexual abuse crisis once again took on massive global proportions.

“It was to be expected that this new radiance of the priesthood would not be pleasing to the ‘enemy,’” Benedict XVI said. “He would have rather preferred to see it disappear, so that God would ultimately be driven out of the world.”

Dear brothers in the priestly ministry, dear brothers and sisters, the Year for Priests which we have celebrated on the one hundred and fiftieth anniversary of the death of the holy Curè of Ars, the model of priestly ministry in our world, is now coming to an end. We have let the Curé of Ars guide us to a renewed appreciation of the grandeur and beauty of the priestly ministry. The priest is not a mere office-holder, like those which every society needs in order to carry out certain functions. Instead, he does something which no human being can do of his own power: in Christ’s name he speaks the words which absolve us of our sins and in this way he changes, starting with God, our entire life. Over the offerings of bread and wine he speaks Christ’s words of thanksgiving, which are words of transubstantiation – words which make Christ himself present, the Risen One, his Body and Blood – words which thus transform the elements of the world, which open the world to God and unite it to him.

The priesthood, then, is not simply “office” but sacrament: God makes use of us poor men in order to be, through us, present to all men and women, and to act on their behalf. This audacity of God who entrusts himself to human beings – who, conscious of our weaknesses, nonetheless considers men capable of acting and being present in his stead – this audacity of God is the true grandeur concealed in the word “priesthood”. That God thinks that we are capable of this; that in this way he calls men to his service and thus from within binds himself to them: this is what we wanted to reflect upon and appreciate anew over the course of the past year. We wanted to reawaken our joy at how close God is to us, and our gratitude for the fact that he entrusts himself to our infirmities; that he guides and sustains us daily.


In this way we also wanted to demonstrate once again to young people that this vocation, this fellowship of service for God and with God, does exist – and that God is indeed waiting for us to say “yes”. Together with the whole Church we wanted to make clear once again that we have to ask God for this vocation. We have to beg for workers for God’s harvest, and this petition to God is, at the same time, his own way of knocking on the hearts of young people who consider themselves able to do what God considers them able to do.

It wasn't anything new, exactly, and a lot less than I had speculated he might do, but Pope Benedict's heartfelt words this morning before a sea of 15,000 priests in white albs in St Peter's Square was still pretty powerful stuff. Speaking at the close of the Year of Priests, on the 150th anniversary of the death of the Curé d'Ars, whose chalice he used for the consecration of the wine, he said:

While the grassroots faithful are being forced to make cutbacks, some bishops enjoy the trappings of the church's considerable hidden wealth.

Shortly before Pentecost, Pastor S. received an unexpected early morning visit, not from the Holy Ghost, but from the police.

For the authorities, the words of the Gospel of Luke came true on that morning: He who seeks finds. More than €131,000 ($158,000) were hidden in various places in the rooms of the Catholic priest, tucked in between his laundry or attached to the bottom of drawers. The reverend was arrested on the spot. After several weeks in custody, Hans S., 76, is now back at the monastery, waiting for his trial.

“I don’t believe Pope Benedict is culpable,” Erlandson told Newsmax.TV. “I believe he’s in fact the right man for the job.”

The Pope may be the person most knowledgeable about all the abuse cases worldwide reported to the Vatican starting in 2001, he says.

And Benedict’s not shying away from the situation. “He’s not only talking the talk, he’s walking the walk,” Erlandson said.

“He’s been addressing the issue forthrightly and has issued numerous apologies. He has met with victims. He has accepted resignations of bishops. He has encouraged local churches to face up to this problem.”

Put that all together, and you have good leadership, Erlandson says.

“One of the ironies of this controversy is that some would look at him to be the fall guy, when he may be the one who can lead us out of this morass.”

The Pontiff has made clear that the truth most be told, even when it puts Catholicism in a bad light. “That signal is being sent to bishops, priests and the laity around the world,” Erlandson says.

And that’s not an easy task. “Contrary to stereotypes about the Catholic Church, the Pope doesn’t just snap his fingers, and Catholics ask how high they should jump. But he’s providing the leadership,” he said.

Erlandson says the urge to blame the Pope stems from three factors.

First, “Americans tend to want to find someone at the top and figure out should that person be fired. They want to have accountability.”

Second, people who are trying to sue the Vatican want to tie it to cases in the United States. Finally, “There are Catholics who have an agenda at work who feel the church has either been too lax or too conservative.” So they’re blaming the crisis on Benedict too.

Erlandson seeks to put the sexual abuse scandal in context with numbers.

There were only six cases reported of alleged clergy sex abuse last year, according to outside auditors, though going back 50 years, there are 11,000 cases being studied regarding more than 4,000 priests.

“Reportedly there are 200,000 cases of sexual abuse a year in the U.S. This is a problem not just for the Catholic church, but for the larger society,” Erlandson said.

He doesn’t see Catholic churches as a cradle for pedophiles or homosexuality. “Pedophilia is a problem wherever you look in society,” he said.

“It’s not linked to homosexuality or celibacy. I don’t believe the church is a haven for this kind of activity. It’s a significant problem in our schools and other religious denominations too.”

As for the media, in some ways it’s done a great job of covering the scandal, Erlandson says. But some opinion pieces are biased. “A lot of people are getting their licks in. That’s where there’s some exploitation going on.”

The scandal is damaging the church greatly, but it’s an ordeal that will only make it stronger, he says.

“Terrible mistakes were made, there were cover-ups, crimes that weren’t dealt with adequately,” Erlandson said. “We’re paying a high price for that and we have to. But I think we’ll get through this.”

The church has faced worst crises, he says.

“We’ve had many other crises, and unfortunately many of them were self-inflicted, but we do get beyond them and find ways to renew and reform ourselves.”

What she did at the end of the song shocked viewers: She held up a picture of Pope John Paul II and ripped it in two.

Eighteen years later, amid continuing revelations of sexual abuse in the Catholic Church, O'Connor's anger is matched by the public worldwide. A Facebook page has even been started called "Apologize to Sinead O'Connor NOW."

Can Benedict XVI and priests command the clouds to rain now over the Vatican? Can Benedict XVI command the dust and fashion it to become an insect, a dog,? No. Benedict XVI and all priests cannot create anything in this life and in their lifetime.

So how can they overpower the Virgin Mary who had to go through 9 months of pregnancy of Jesus in her womb?

VATICAN CITY – Pope Benedict XVI begged forgiveness Friday from clerical abuse victims for the sins of priests and promised to "do everything possible" to ensure that prelates don't rape or molest children ever again.

Benedict's pledge was similar to comments he has made in the past. But it was uttered in the highly symbolic setting of a Mass in St. Peter's Square concelebrated by 15,000 white-robed priests, all marking the end of the Vatican's Year of the Priest — a year marred by revelations of hundreds of new cases of clerical abuse, cover-ups in several nations and Vatican inaction to root out pedophiles.

In his homily, Benedict lamented that during what should have been a year of joy for the priesthood the "sins of priests came to light — particularly the abuse of the little ones."

"We too insistently beg forgiveness from God and from the persons involved, while promising to do everything possible to ensure that such abuse will never occur again," he said.

He said in admitting men into the priesthood and in forming them as clergymen "we will do everything we can to weigh the authenticity of their vocation and make every effort to accompany priests along their journey, so that the Lord will protect them and watch over them in troubled situations and amid life's dangers."

His comments were similar to those reported by the Vatican during his private meeting with abuse victims in Malta in April, during which the pontiff had tears in his eyes as he heard the stories of men molested by priests as children.

Benedict also made similar comments last month en route to Portugal, in which he acknowledged that the "sins from within the church" were responsible for the scandal, not the media or some outside anti-Catholic lobby.

As such, Friday's comments were a public admission of the sins of priests, a request for forgiveness from their victims and God, and pledge to take action — all delivered before priests who came to Rome from around the world to support the pontiff and the priesthood itself amid the scandal.
Victims groups who had been hoping for a mea cupla and clear-cut action plan to protect children weren't satisfied.

"A promise is nominally more helpful than an apology. But promises are usually easy to make, hard to keep and broken often if there's no oversight or penalties," said Barbara Blaine, president of the U.S. victims group SNAP, the Survivors Network of those Abused by Priests.

She said the crux of the problem remained the "nearly limitless power" of bishops and a church structure and culture that allows them to be "virtually answerable to no one." She said that had allowed abusive priests to remain in the ministry for decades.

Benedict's own legacy has been tarnished by the scandal, since he was archbishop of Munich in the 1980s when he approved therapy for a suspected pedophile who was allowed to resume pastoral duties while being treated. The priest, the Rev. Peter Hullermann, later was handed a suspended sentence for molesting a boy.

In addition, Benedict's legacy at the Vatican office that dealt with sex abuse has come under scrutiny.

Benedict said the scandal had shown the need for a purification of the church.

"Had the Year for Priests been a glorification of our individual human performance, it would have been ruined by these events," he said. "But for us what happened was precisely the opposite: We grew in gratitude for God's gift."

A Spanish priest who attended Friday's Mass, the Rev. Davide Torrijus, concurred.

"We have all suffered during the year of the priests" because of the scandal, he said. "It was good for the pope to show also the positive aspects — gratitude for the gift."

Currently all those more than 6,000 alleged pedophile priests that were settled out of court or in court by all dioceses in the USA are not known. Their files are confidential and therefore they are free to prey on young altar boys and the parents are all gullible to welcome these predators into their homes and in their midst.

Cardinal Roger Mahony alone spent tens of millions of dollars to keep the files of more than 600 pedophile priests in Los Angeles confidential. Up to today, Los Angeles harbours the largest number of pedophile priests in US history with the largest settlement of $660 millions dollars to their victims. Sex abuse: Bertone says 'infidelity' of some priests will give birth to 'spiritual renewal'

June 10, 2010. In front of four thousand priests, the Vatican's second highest authority, Cardinal Tarcisio Bertone, said cases of sexual abuse undermine the Church's credibility. But he also said that the pain caused by this will bring a “spiritual renewal”.

“In this period we have had to carry the pain of infidelity, at times grave, of some members of the clergy who have negatively influenced the credibility of the Church. Because of this, the Pope, responding to journalists on his trip to Portugal, spoke of a 'persecution' born within the Church.”

It was during a gathering of priests from all over the world organized by the Focolare and Schönstatt Movement, for the ending of the Year for Priests.

The cardinal said the pope is calling for “conversion and purification.”

In Vatican lawsuits, who’s really the little guy?

Over the last decade, the Vatican has been hit with at least ten lawsuits in American courts, on matters ranging from an insurance scam to the sexual abuse crisis. Off and on I’ve written about these cases, and I’ve always been curious about one odd feature of the story: How is it that the Vatican’s legal brain trust in the States ended up concentrated in the notoriously left-leaning, anti-establishment haven of Berkeley, California?

In the abstract, Berkeley hardly seems the most obvious place to seek advocates for one of the world’s last remaining monarchies.

In search of an answer, I spent Tuesday of this week with Berkeley native son Jeffrey Lena, the principal architect of the Vatican’s legal strategy, and here’s what I discovered:

Understanding the Berkeley connection depends in part on answering the question, “Who’s really the little guy?”

As fate would have it, Tuesday was the day Lena and his colleagues filed a brief with the United States Supreme Court asking it to take up an Oregon case, Doe v. Holy See, in which a federal appeals court ruled last year that a lawsuit against the Vatican could proceed.

Lawyers for the victim in the Oregon case filed their own brief the same day, urging the Supreme Court to stay out of it. Both sides were reacting to a recent opinion from the Obama administration, signed by the Solicitor General’s Office, the Justice Department and the State Department, essentially endorsing the Vatican’s view that the Foreign Sovereign Immunities Act of 1976 shields it from liability in the Oregon case.

The competing briefs are the latest development in the long-running saga of efforts to sue the Vatican in American courts. Of the ten suits brought to date, six have been resolved in the Vatican’s favor and four are still open. It’s not yet clear whether American courts will ultimately decide that they have jurisdiction over the remaining claims, three of which feature sex abuse victims seeking to hold the Vatican accountable.

For most Americans, these cases probably seem analogous to legal fights against Big Tobacco: The victims represent the “little guy,” struggling for justice against the institutional behemoth of the Holy See. The natural temptation is to cheer for the victims, and to see the Vatican’s assertion of immunity as yet another index of its arrogance.

Lena, however, says there’s another way to look at things.

What if we cast the Holy See, by consensus the smallest sovereign state on earth, as the “little guy” in these cases, defending the rights of all small states not to be pushed around by the court system of the world’s biggest superpower? In other words, what if we shift the context from the sex abuse crisis to equality in international relations?

For Lena, who did graduate work in history at UC-Berkeley, a framework based on concerns over the modern projection of American power around the world -- which, he says, can at times border on hegemony -- seems right on the money.

Understandably, Lena is reluctant to talk much about his own vision of these cases – his job, after all, is to represent his client. Moreover, Lena insists that he is determined to fight these claims because of the Vatican’s “factual innocence.” He says it’s just not true that decisions about transferring abuser priests or concealing their crimes were made in Rome, as these lawsuits generally allege. Lena insists that Vatican officials often never even knew these priests existed until they were being dismissed from the clerical state (usually long after the abuse had occurred), or their names popped up in the press.

But Lena also sees a bigger picture: Preserving a level playing field on the international scene. Respect for sovereign immunity (and international law generally), he argues, is a bulwark against strong states imposing their will on weaker ones.

Though Lena wouldn’t use this language, what’s really at stake in the Vatican lawsuits, from this point of view, is what diplomats often call a choice between the “force of law” and the “law of force” in relations among states. In other words, should nations which lack significant military and economic muscle be subject to the dictates of superpowers?

For the record, Lena says he can understand why it’s hard for victims to see things that way. He’s often said that he admires the courage of victims in coming forward, and he’s surprisingly gracious about the lawyers who represent them -- noting that their actions offer a classic example of the power of civil litigation in America to engender social reform.

Yet Lena also wants people to perceive a deeper drama to these cases, as American courts grapple with what is perhaps the most important legal question any court can ask: “What’s the extent of our power to hear a case?” An aggressively expansionist view of jurisdiction, he argues, can unwittingly produce a shift in the global balance of power.

That way of framing the issue is undoubtedly closer to the way many Vatican officials see things, and it also dovetails with the Holy See’s longstanding diplomatic efforts in favor of “multilateralism,” meaning a more equitable international system. A large part of the reason popes have repeatedly called for a stronger system of global governance -- as Benedict XVI put it in Caritas in Veritate, a global system with “real teeth” -- is to ensure that smaller states have a meaningful voice in global affairs, as opposed to being subject to superpower dictates. (That was also an important reason the Vatican opposed the U.S.-led invasion of Iraq in 2003, insisting that any decision on a use of force should have come from the United Nations.)

Of course, Lena knows that “American Exceptionalism” is hardwired into our cultural DNA, and this can foster in our courts -- or our politicians, or our military -- some sense of moral duty to right wrongs around the world. Yet experience teaches that when America is perceived as unilaterally imposing its values, the consequences for its global reputation and the success of its diplomatic efforts can be toxic. There’s also a more pragmatic argument for restraint, which is that how American courts treat other nations today may be the way foreign courts treat the United States in the future.

Interestingly, Lena says that American reporters have essentially ignored this aspect of the story, whereas foreign reporters grasp it immediately. What this suggests, perhaps, is that understanding these cases in terms of weak states and superpowers, rather than just victims and the Vatican, comes more naturally outside American airspace.

Maybe it took a Berkeley guy whose orientation is internationalist and historical, rather than merely legal, to see defending the Vatican as a way of addressing concerns about unwarranted expansion of U.S. power. Nonetheless, Lena raises a question that’s at least worth pondering: Ultimately, what are these cases about? Are they about seeking justice for the victims, or are they about ensuring that American courts do not become the arbiters of all the world’s ills?

Even if the most convincing answer may be “both,” that alone suggests there’s more at stake in the business of suing the Vatican than meets the eye.

I fail to comprehend how priests that sexually abuse parishioners and/or their children and suing the Vatican, employer of these priests, can be construed as “American Exceptionalism”. Is it common practice to condone sexual abuse in other countries? Is it not the responsibility of the accused (Vatican) to prove their case? These abuse cases occurred in the United States of America, not another country. I find it hard to believe those who have experienced abuse are concerned about other countries, but more about seeking justice here at home by the company (Vatican) that employees the offenders.

How did Lena acquire insight as he stated: "He says it’s just not true that decisions about transferring abuser priests or concealing their crimes were made in Rome, as these lawsuits generally allege. Lena insists that Vatican officials often never even knew these priests existed until they were being dismissed from the clerical state (usually long after the abuse had occurred), or their names popped up in the press." Did he personally examine Vatican employees? Did he acquire sworn and witnessed testimony from these employees?

While it may be true that "What if we cast the Holy See, by consensus the smallest sovereign state on earth," I have a hard time seeing the Vatican as "the “little guy” in these cases, defending the rights of all small states not to be pushed around by the court system of the world’s biggest superpower?" I also fail to comprehend why he would conclude with the following statement: "In other words, what if we shift the context from the sex abuse crisis to equality in international relations?" To the best of my knowledge, the United States of America is not the entity suing the Vatican, rather it is individuals who have been harmed.
While the Vatican may be small in size, it is extremely wealthy and has access to an enormous army of religious and parishioners. Count the people and the money before claiming the Vatican is the "little guy".
It is time we get to the bottom line. I am pretty sure Matthew 25:40 did not refer to states, no matter how large or small.

The Church is a legal chameleon...it's not a country with diplomatic privilege until they need to get out of a lawsuit; it doesn't employ bishops, but it is the only entity which can fire and hire bishops...

To position this as a question of sovereign immunity where, for example, someone might win a judgement in the future that would allow them to take over Monaco is just ridiculous.

That is the straw at which Lena is grasping. Unfortunately, for reasons other than the genuine principle of respecting sovereignty, other governments including ours seem prepared to help him to do so.

We should distinguish between The Vatican (the state) and The Vatican (the parent corporation of the largest multi-national non-profit corporation).

Imagine if BP purchased a privately-held island, declared it to be "The Republic of BP," and then moved its corporate headquarters there.
Would they be able to hide behind "soverign immunity" to avoid liability for the oil spill in the Gulf?

This is exactly what Lena and his client are trying to sell us.

Over the centuries the Vatican has engaged in its own brand of “hegemony” — welding its political and military power like a sledgehammer of torture and murder until it finally lost its vast territories… reduced to land holding that can be measured in acres as the result of its own political arrogance. Now it wants to posture as poor “little guy” me. Of course the Vatican wants to “shift the context from the sex abuse crisis to equality in international relations”. Shifting the focus has been the ongoing game-plan since the tidal wave of abuse revelations began.

2. What about “Vatican Exceptionalism”? A “level playing field”? Really? What sort of 'level field' do we have when those sexually abused during their minor years are up against the affluence and political/religious exceptionalism of an arrogant Vatican State — a state which claims diplomatic immunity, and shields sexual predators and their accomplices within its confines. Of course the Vatican wants “smaller states to have a meaningful voice in global affairs” since the Vatican itself is now a “small state” among many nations. What they don’t want is accountability and consequences for their criminal behavior. That is the bottom line at the end of all the parsed legal-speak.

3. Yes indeed the United States government has a vested interest in not setting precedent for international accountability for crimes committed. Sadly, our own government has shamelessly committed wars crimes in the name of its own perceived “exceptionalism” — torturing prisoners, and violating our own federal laws and international laws. To this day our own predator drones are bombing entire villages of civilians (including women, children and the unborn) off the map, in the bizarre hope of killing perhaps one designated “terrorist”. Our own government, like the Vatican, claims the superior moral high ground while simultaneously engaging in, or tacitly condoning, the most heinous of crimes.

Vatican's US attorney responds to Supreme Court action

Jeffrey Lena, the California-based attorney who represents the Vatican in American litigation, issued this statement following the announcement that the U.S. Supreme Court would not hear an appeal from the Holy See.

The Vatican was asking the federal court to stop a law suit filed in Oregon that accuses the Vatican of transferring a priest from city to city despite repeated accusations of sexual abuse.

Lena's statement:

"Today the Supreme Court decided not to grant the Holy See's petition for certiorari. These decisions are made based upon the Supreme Court's docket and what cases it wishes to hear each term. The decision not to hear the case is not a comment on the merits of our case (importantly, the United States does agree that we are correct on the merits). The effect of the Supreme Court's decision is to cause the case to return to the district court in Oregon, where the additional remaining defenses will be heard. Plaintiff currently has one jurisdictional theory left. That theory is that the priest who committed the abuse was an "employee" of the Holy See.

In Arizona we have racial profiling. Now, around the world, wherever the Catholic church holds sway, we have sexual profiling. In The New York Times, Paul Vitello reports on the new screening tests the church is implementing to weed out would-be seminarians who are gay or who are considered prone to pedophilia. In Arizona, police are meant to demand papers from anyone they sense could be an illegal alien. In the church Rev. David Toups, director of the secretariat of clergy for the United States Conference of Bishops, says of his own gaydar: “It’s more like one of those things where it’s hard to define, but I know it when I see it.”

Some may think it a matter of progress if the church is aware of danger coming from pedophiles in the ranks. And if tests become elaborate, to go beyond Father Toups’s educated hunches, so much the better. But read what applicants to the seminaries are going to be asked, and apply the same tests to a would-be medical student, or law student, or science professional, and it will be clear what absurdity the church has backed itself into. Just consider the questions Vitello has found being proposed for the would-be priest, and imagine them being asked of an applicant for other jobs:

When was the last time you had sex?

What kind of sexual experiences have you had?

Do you take cold showers?

Vitello goes on:

Most candidates are likely to be asked not only about past sexual activities, but also about masturbation fantasies, consumption of alcohol, relationships with parents, and the causes of romantic breakups. All must take HIV tests and complete written exams like the 567-question Minnesota Multiphasic Personality Inventory, which screens for, among other things, depression, paranoia, and gender confusion. In another test, candidates must submit sketches of anatomically correct human figures.

Defenders of this program might say that it differs from the professional reviews required of doctors or lawyers because priests deal with intimate human needs. Doesn’t a doctor? Don’t lawyers, when they deal with sticky divorces or child custody issues? In the modern world, many people feel closer to their doctors or lawyers (or accountants) than to their priests.

No, the new screenings are proposed because the church has trapped priests inside three doctrinal positions — that homosexuality is “objectively disordered,” that women cannot be priests, and that celibacy is mandatory for all priests. All three positions are eminently challengeable in themselves. But put together they make for a poisonous mix. You can be a good doctor or lawyer and be gay. You can be a good lawyer or doctor and be a woman. You can be a good lawyer or doctor and be married. But all such possibilities are ruled out for priests.

Besides, there is nothing in being a lawyer or doctor (or scientists or engineer) that makes those callings especially attractive to single men or gay men. But the church has been a magnet for gays, as one sees in Ellis Hanson’s Decadence and Catholicism and Douglass Shand-Tucci’s Boston Bohemia. The exotic rituals and vestments, the incense and candles, the authors note, were very attractive to men like Aubrey Beardsley, Joris-Karl Huysmans, and Oscar Wilde. Federico Fellini made light of this when he filmed his camp Vatican fashion show in Fellini’s Roma – the cope and morse, the gloves and slippers, the silks and jewels. As over-the-top as Fellini’s “nunway” seems, it hardly goes beyond the glittery and sequined cope and tasseled mitre on Pope Benedict in the cover picture of the June 7 Time magazine.

It is not surprising, then, that a number of priests are gay – Vitello quotes “some Catholic scholars” putting the number between 24 and 40 percent of the priests, though “other experts” think the number is smaller. No, the new screenings are proposed because the church has trapped priests inside three doctrinal positions — that homosexuality is “objectively disordered,” that women cannot be priests, and that celibacy is mandatory for all priests. All three positions are eminently challengeable in themselves. But put together they make for a poisonous mix. You can be a good doctor or lawyer and be gay. You can be a good lawyer or doctor and be a woman. You can be a good lawyer or doctor and be married. But all such possibilities are ruled out for priests. Besides, Mark D. Jordan, the R. R. Niebuhr professor at Harvard’s Divinity School, says that the odds are that the new screening rules will be enforced, ridiculously, by men who are themselves gay.

What does it take to make the hierarchy see that its mandatory celibacy rule is self-destructive for the church? Vitello notes that “half of the nation’s seminaries have one or two new arrivals a year, and one-quarter get none.” That number is bound to be reduced even further by this new obstacle course. No self-respecting person aspiring to be a doctor or lawyer would put up with such absurdly intrusive questioning. Neither should anyone who thinks there is some remaining dignity to the priesthood.

Ron Johnson, the Republican blessed by his party to challenge Democratic U.S. Sen. Russ Feingold, is often described as a political blank slate:

No history of messy campaigns.

No legislative voting record.

Just a few interviews on conservative talk radio and some tea party speeches.

But there is one issue that Johnson feels passionately about - passionate enough to insert himself into the debate.

Prodded by a Catholic official, the Oshkosh businessman earlier this year jumped into the controversy over legislation aimed at making it easier for victims of childhood sexual abuse to sue their abusers.

Johnson, a Lutheran, sided with Catholic Church leaders in opposing the so-called Child Victims Act before a state Senate committee in January. The bill failed to win approval.

Here was the heart of his testimony:

"I believe it is a valid question to ask whether the employer of a perpetrator should also be severely damaged, or possibly destroyed, in our legitimate desire for justice."

Johnson had little to say about the victims of sexual abuse in his testimony. His was largely a financial concern.

He followed that up with this suggestion.

"This bill could actually have the perverse effect of leading to additional victims of sexual abuse," he argued, "if individuals, recognizing that their organizations are at risk, become less likely to report suspected abuse."

That argument doesn't sit well with victims of pedophile priests.


Peter Isely, the Midwest director for the Survivors Network of those Abused by Priests, said the Catholic Church has been more likely to cover things up if it is not faced with court action.

"He's just wrong," said Isely, who was not aware that Johnson had testified.

Not surprisingly, a Feingold spokesman took a shot at his likely GOP opponent for his stance on the issue.

"People want a senator who is going to fight for victims of abuse, not lobby against them," said John Kraus, a senior strategist for the incumbent Democrat. "If he won't stand with children who are victims of abuse, who will he stand with?"

Here are the key political questions:


Why did a guy considering a run for statewide office decide to jump into a controversy that cuts across party lines? What upside could there be?

Only Johnson can answer those.

In an interview last week, he said he was first contacted on the issue by Deacon Tim Reilly, director of administration for the Catholic Diocese of Green Bay. Though a Lutheran, Johnson is a big backer of Catholic schools and was serving on the diocese's finance council at the time of his testimony.

The proposal would have eliminated the statute of limitations for future victims of child sex abuse and opened a three-year window for past victims.

It was opposed by the insurance industry and church organizations, including the Archdiocese of Milwaukee, which argued the bill could bankrupt it. The measure had the support of several police organizations, social workers and Milwaukee County District Attorney John Chisholm.

Late last year, Johnson attended a briefing on the legislation for various Catholic officials held by state Sen. Randy Hopper, a Republican from Fond du Lac. During that meeting, Johnson, who sits on the boards for various nonprofits, said he became concerned about the unintended consequences of the bill on groups in addition to the Catholic Church.

"I think it was actually Randy Hopper who said, 'That's a perspective that would be handy to have,' so after that meeting, I got an e-mail from Tim saying when the (Senate Judiciary Committee) hearing would be," Johnson explained.

Johnson emphasized that his statement represented his own thoughts, not those of the diocese.

Isely finds the whole arrangement bizarre.

"It's interesting they send a Lutheran down to fight a Catholic cause," Isely said. "What would Martin Luther say?"

A couple of hours after Johnson talked to No Quarter, a top Republican Party official sent an unsolicited defense of the candidate's actions. The state party has endorsed Johnson, who is running against Watertown businessman Dave Westlake for the Republican nomination.

First, Mark Jefferson, executive director of the state GOP, suggested that the newspaper focus on Assembly Majority Leader Tom Nelson for his role in killing the bill. Jefferson also said the measure was poorly crafted.

"The fact that the bills went nowhere, in a Dem-controlled Legislature no less, shows that this well-intentioned bill wasn't fully thought out or ready for prime time," he wrote.

Actually, the legislation can't be easily pigeon-holed as a partisan effort.

While many sponsors were Democrats, there were a dozen Republicans in both houses who signed onto the bill. Johnson's own representative in the Assembly, Richard Spanbauer, backed it in committee.

More important than any of that, Isely said, is that Johnson sits on the Green Bay Diocese's finance council. Isely asked what Johnson had done in that post about the 51 priests there who SNAP says are the subject of credible claims of abusing children and minors.

"Regardless of the bill, he's in an extremely unique position that very few people are in to insist and demand accountability and transparency from the organization that he is defending here" in his legislative testimony, said Isely, who has no ties to Feingold's campaign.

In response, Johnson emphasized that the finance committee meets only three times a year and focuses primarily on balancing the budget. He resigned from the post to run for the Senate.

He wanted to emphasize that he has no sympathy for clergy sex offenders.

"Actually, had I not been put on the clock (in the state Senate), I would have made another statement," Johnson said. "I can't think of a penalty that would be too harsh for these guys. I don't think people that prey on children deserve a second chance. I guess God can give them one, but I sure don't think our courts and legal system should."

New Vatican campaign to clamp down on 'liberal opinion'

VATICAN investigators to Ireland appointed by Pope Benedict XVI are to clamp down on liberal secular opinion in an intensive drive to re-impose traditional respect for clergy, according to informed sources in the Catholic Church.

The nine-member team led by two cardinals will be instructed by the Vatican to restore a traditional sense of reverence among ordinary Catholics for their priests, the Irish Independent has learned.

Priests will be told not to question in public official church teaching on controversial issues such as the papal ban on birth control or the admission of divorced Catholics living with new partners to the sacraments -- especially Holy Communion.

Theologians will be expected to teach traditional doctrine by constantly preaching to lay Catholics of attendance at Mass and to return to the practice of regular confession, which has been largely abandoned by adults since the 1960s.

An emphasis will be placed on an evangelisation campaign to overcome the alienation of young people scandalised by the spate of sexual abuse of children and by later cover-ups of paedophile clerics by leaders of the institutional church.

A major thrust of the Vatican investigation will be to counteract materialistic and secularist attitudes, which Pope Benedict believes have led many Irish Catholics to ignore church disciplines and become lax in following devotional practices such as going on pilgrimages and doing penance.

Bishops and priests will be instructed to preach to their congregations the unchanging central message of Jesus Christ about love, healing and repentance.

While the restoration of church discipline and pious practices such as praying to Our Lady and the saints will be welcomed by regular church-goers, the Vatican investigation is likely to face a backlash from liberal Catholics who want more accountability and democracy in church decision-making.

Visitation

Vatican officials are finalising the precise terms of the instructions for the investigators named last week by Pope Benedict, who initiated an 'Apostolic Visitation' last March in his pastoral Letter to the Catholics of Ireland.
The investigators are clearing their diaries to visit Ireland's four principal archdioceses, the national seminaries and study centres run by religious orders in the autumn.

In the wake of the shocking Murphy report into clerical child abuse, the conservative Archbishop of New York, Timothy Dolan, will examine the study courses conducted for trainee priests at the national seminaries in St Patrick's College, Maynooth, and the Pontifical Irish College in Rome.

At a meeting held in Maynooth last month, Archbishop Dolan told a gathering of priests "to return to basics" and to ground their ministry in "prayer, humility and a rediscovery of identity".

Archbishop Dolan's address, titled "God is the only treasure people desire to find in a priest", was the high point of the Irish church's celebration of The Year of the Priest, a campaign to encourage vocations to the priesthood.

The hardline address was enthusiastically endorsed by Cardinal Sean Brady, the Primate of All Ireland and Archbishop of Armagh.

This week, as part of the Vatican's rigorous restoration policy, a widely promoted rally will be staged in Rome to cap what Pope Benedict has called "The Year of the Priest".

Thousands of priests from across the world, including from Ireland, are expected to attend the showcase event which is planned as a major spectacle trumpeting the special status of the priesthood.

An Irish newspaper reports that the upcoming Vatican "visitation" of Ireland's Catholic church (involving two US prelates - NY Archbishop Timothy Dolan and Boston's Cardinal Sean O'Malley) will likely concentrate on increased evangelization," fighting "secularization," boosting confession and mass attendance and similar “measures” of how devout parishioners may or may not be. The internal church probe was announced weeks ago by the Pope and is supposedly to deal with horrific revelations of widespread child sex crimes and cover ups in Ireland.
If this report is accurate, this is extremely disheartening. Clergy sex crimes and cover ups happen when church officials are “liberal” or “conservative,” and whether the flock is “devout” or “lax.” Even discussing such matters detract from the real task at hand: protecting the vulnerable, healing the wounded, exposing the truth, and deterring future recklessness, callousness and deceit.

Focusing on the laity, especially regarding mass attendance and confession, more than “misses the boat.” The problem has been and remains a rigid, secretive, self-serving all-male monarchy that consistently puts its own comfort and reputation above the safety and well-being of its flock.

There’s no need for an “evangelization” campaign. If bishops truly reform - and oust wrongdoers, protect kids and help victims - Catholics will likely return to the church. If bishops refuse, however, Catholics won’t.
